Orlando Graffiti Crime Defense
Graffiti can be found within the criminal mischief statute in s. 806.13(6) of the Florida statutes. The penalties for criminal mischief are the same for graffiti crimes and are based on the amount of damage to property. However, with graffiti there are additional mandatory fines.
- Not less than $250 for a first conviction.
- Not less than $500 for a second conviction.
- Not less than $1,000 for a third or subsequent conviction.

Additional Mandatory Community Service
Additionally, any person convicted under this section when the offense is related to the placement of graffiti shall, in addition to any other criminal penalty, be required to perform at least 40 hours of community service and, if possible, perform at least 100 hours of community service that involves the removal of graffiti.
Suspension of a Minor's Drivers License
If a minor is found guilty of graffiti, the parent or legal guardian of the minor is liable along with the minor for payment of the fine. In addition, if a minor is found guilty for placing graffiti on any public property or private property, and the minor is eligible by reason of age for a driver's license, the court shall direct the Department of Highway Safety and Motor Vehicles to revoke or withhold issuance of the minor's driver's license or driving privilege for not more than 1 year. If the minor's drivers license is already suspended for other reasons the suspension will be extended for up to an additional year.
