If I was adjudicated guilty, can I still get my record sealed or expunged?

No. In order to expunge a criminal record the case must have been dropped, dismissed, or ended in an acquital after trial. To seal a criminal record the criminal record must have resulted in a withholding of the adjudication.

My case was dropped and the only adjudication of guilt I have occurred AFTER the the case I want expunged. I'm eligible, right?

Wrong. Unfortunately, under Florida law a person applying to have a criminal record sealed or expunged can never have been adjudicated guilty under any law including other states and countries. This applies before and after the arrest that is sought to be sealed or expunged.

I qualify to have a criminal record expunged. How long does it take?

Once started, an expungement can take up to 8 months to be completed. With an inexperienced attorney or trying this without an attorney the time can be significantly longer. A sealing may take slightly less time.

I successfully completed a pretrial diversion program. Can I expunge this criminal record?

Typically, yes. A case that goes through diversion and is dropped by the government usually qualifies for an expungement.
