How To Expunge a Criminal Record in Florida

Florida law allows for a person to seal or expunge a criminal arrest record. Any case that has been dismissed, dropped, or no billed is eligible to be expunged. Most criminal records of arrests that result in a withhold of adjudication are eligible to be sealed.

First, Getting Your Record Expunged in Florida; Eligibility

It must be determined if the person seeking to have a criminal record expunged is eligible. Florida law has specific requirements that must be met before a person can petition the court to expunge (or seal) a record. Read the steps below and see if you qualify.

STARTING THE CRIMINAL RECORD EXPUNGEMENT

STEP ONE Determine what type of expungement (expunge record) or sealing (seal record) you really need.
  • If you have never been arrested but have an arrest or arrests appearing on your criminal history background check, then go to the Correct Your Criminal Record page.
  • If you were arrested due to a mistake (for example, arrested on a warrant for a person with the same name as you) then go to Administrative Expungements page.
  • If you are a juvenile (under 18 years of age) please go to the Juvenile Seal and Expunge page first.
  • If you were arrested for any other reason please continue on to Step Two or just call us - we can help you figure this out.
STEP TWO The next thing needed to be done is to ask yourself these questions:
  • Have I ever been adjudicated "delinquent" of a crime as a juvenile?
  • Have I ever been adjudicated "guilty" of a crime as an adult? (or was adjudication withheld)
  • If I pled guilty or no contest for the arrest I want sealed or expunged did the judge adjudicate me "guilty" or "delinquent" of any charge against me?
  • Have I ever sealed or expunged a prior arrest record anywhere before today?

STEP THREE Go to the Florida Expungement Forms Packet page and submit the information requested. Be specific and do not guess (leave blank if you don't know). This will complete the information we require to begin the process of sealing or expunging your Florida criminal record. If you have questions please call (407) 841-5555. STEP FOUR How Much An Expungement or Sealing Costs: If you decide to do this on your own our fee to prepare the forms is $150.00. If you decide to hire us the total out of pocket cost to you runs two payments of $300 and about $150 in costs. The payments are spread out over the 6-8 months it takes to complete the process. STEP FIVE After you hire us for representation or just the expungement packet we will be sending you some documents. Follow the instructions. If you have hired us to represent you - check your email periodically, and relax. We will take care of everything else. If you have decided to represent yourself we wish you the best. Remember, you can always hire us later and we will compensate you for the $150 cost of the Forms Packet in most situations.
