MORE WHEELIES: As of October 1, 2008, the Florida law that popping a wheelie on a motorcycle was per se Reckless Driving has also been repealed. It is a noncriminal traffic infraction however and the fine is $1,000 unless you hire an attorney to try and get it reduced.

Our Legislature has corrected the draconian statute, for now...

§316.2085(3) - The license tag of a motorcycle or moped must be permanently affixed to the vehicle and may not be adjusted or capable of being flipped up. No device for or method of concealing or obscuring the legibility of the license tag of a motorcycle shall be installed or used. The license tag of a motorcycle or moped may be affixed horizontally to the ground so that the numbers and letters read from left to right. Alternatively, a license tag for a motorcycle or moped for which the numbers and letters read from top to bottom may be affixed perpendicularly to the ground, provided that the registered owner of the motorcycle or moped maintains a prepaid toll account in good standing and a transponder associated with the prepaid toll account is affixed to the motorcycle or moped.

PENALTIES: Fined as a moving violation under chapter 318.

COMMENT: Much better than old statute but it is still a $1000.00 fine.

WHAT YOU SHOULD DO if you receive this ticket. Decide whether you want to keep getting these type of tickets. If not, fix the license plate attachment to comply with the statute. Provide proof either by receipts or photographs. Call us if you do not want the hassle of going to court. These are considered "moving violations" and will carry points against your drivers license.
