Below is a sample breakdown of Florida's laws against drugs. Using several common drugs found in Florida you can clearly see the various and increasingly severe penalties based on type and weight. Some Common Drugs And Penalties

Some common drugs and there penalties under Florida law. This list includes penalties for drug trafficking however under Florida law drug trafficking has additional enhancements (see Florida Drug Trafficking Penalties and the Florida Drug Trafficking Statute for additional information). The table below is presented to give you a quick visual idea of the penalties that can occur for simply possessing drugs in Florida.

Under the minimum sentence column there are blocks shaded red. These indicate minimum mandatory sentences. This means if you are found guilty of possessing that amount of drugs the court must sentence you to that amount of time or more. Minimum Mandatory Sentences must be served day for day. There is no gain time for a minimum mandatory sentence.

Special Conditions of Probation for Drug Offenses

Randon Urinalysis Screenings

If you were arrested for a small amount of a less serious drug you may be placed on probation. Special conditions of probation are those things the Court requires you to do above and beyond the general conditions of probation. In a drug case the Court will order that you comply with random urinalysis screenings. This is a general condition of probation but by making it a special condition the Court is telling probation to test you and to test you often. These can occur during your monthly visit to your probation officer or he or she can just appear at your home or work and require you to provide a sample. Testing positive for drug use is a violation of probation.

Substance Abuse Evaluation And Counseling

Florida Courts typically order you to undergo a substance abuse evaluation and to successfully complete any recommended treatment. This means you will have to do counseling and counseling centers also do urinalysis screenings. A positive urinalysis screening or failure to comply with counseling is a violation of probation.
