DUI DWI - Drunk Driving: A very complicated
charge to
defend.
The DUI offense (same as DWI)
is one of the most
complicated cases to defend. People are charged with drunk driving offenses daily. Most of the time the evidence against a
person includes the driving pattern, his/her physical appearance, the odor of
alcohol impurities, field sobriety exercises, the breath test machine (known as
the Intoxilyzer 8000), and witness statements. None of the evidence
has any basis in scientific methods although that is how the State will
try to sell the jury on your guilt.
Punishment Severe
Public sentiment and politics has made the punishment for a
drunk driving
offense quite severe. An adjudication of guilt is required for all pleas
of guilty or no contest to a DUI. That means it is a permanent mark on
your record. Additionally, unless you act within 10 days of your arrest
for DUI, your license will be suspended for a minimum of 6 months with a minimum
hardship period (no drivers license at all - no driving) of 30 days. These
are minimums.
Minimum fines, minimum community service, impoundment of vehicle, minimum
jail sentences all vary with the number of prior DUIs the accused has, whether
injury or property damage occurred, and what the breath test results were. It is important to act quickly after you have been arrested for this
offense. Hire an attorney who is experienced handling drunk driving charges and ask
questions: Has the attorney handled a DUI case before? Has he/she
gone to trial? Will he/she handle the formal review hearing to try and prevent
your license suspension?
