Offenses that CANNOT be Sealed.

Please read carefully: The below listed offenses cannot be sealed if you have been found guilty of committing it.  To have been found guilty you would have had to enter a plea of guilty or no contest, or had been found guilty by a jury after a trial.  These offenses are prohibited even if adjudication of guilt was withheld.  (Important: If you were arrested but your case was dismissed or otherwise dropped then you may still be eligible for an expungement of the below listed offenses.).  Red lettering indicates new prohibited offense.
  • §393.135 - Sexual misconduct with developmentally disabled person
  • §394.4593 - Sexual Misconduct with the mentally ill person
  • §787.025 - Luring or Enticing a Child
  • §794 - Sexual Battery
  • §796.03 - Procuring person under age 18 for prostitution
  • §800.04 - Lewd or Lascivious act committed on or in presence of child < 16
  • §810.14 - Voyeurism
  • §817.034 - Scheme to Defraud
  • §825.1025 - Lewd or Lascivious act committed on or in presence of elderly or disabled person
  • §827.071 - Sexual Performance by a child
  • §839 - Offenses by Public Officials or Employees
  • §847.0133 - Delivery of obscene material to a minor
  • §847.0135 - Computer Pornography
  • §847.0145 - Selling or Buying of minors for purposes of pornography
  • §893.135 - Trafficking in a controlled substance
  • §916.1075 - Sexual misconduct with mentally deficient of mentally ill
  • §907.041 - [Enumerated Offenses]
    • arson
    • aggravated assault
    • aggravated battery
    • illegal use of explosives
    • child abuse or aggravated child abuse
    • abuse of an elderly or disabled adult (aggravated)
    • aircraft piracy
    • kidnapping
    • homicide
    • manslaughter
    • sexual battery
    • robbery
    • carjacking
    • lewd, lascivious assault in the presence of a child under 16 years.
    • sexual activity with a minor 12 or older but les than 18 by person in familial or custodial authority
    • burglary of a dwelling
    • stalking or aggravated stalking
    • an act of domestic violence
    • home invasion robbery
    • act of terrorism
    • manufacturing any substance in violation of Chapter 893.
    • attempting or conspiring to commit any above mentioned crimes.
  • NOTE: If you pled guilty or no contest to any DUI - it cannot be sealed or expunged because Florida Law requires that a DUI be "adjudicated guilty."  If it was reduced to anything other than DUI you should find out if the resulting charge (e.g., reckless driving) resulted in an adjudication of guilt.

WAIT: If you were arrested for an above listed offense but your case was ultimately dismissed or dropped then you may qualify to expunge that arrest!
