If you were arrested for a DUI
- your license is automatically suspended by
DMV. What can you do to get it back?
Upon arrest and regardless of the results of your field sobriety exercises
and/or your breath test results the Department of Highway Safety and Motor
Vehicles (DHSMV) suspends your license. The result of this is that you may
be acquitted of the charge of DUI but still have had your license suspended.
There is only one way to try and get your license back from a DHSMV suspension -
you or your attorney must request a hearing with the DHSMV within 10 days of
your arrest. Below are listed the addresses and phone numbers of the DHSMV

Immediately after your arrest and request for
hearing you should attend and
complete a DUI Counter-attack Class. If the administrative suspension is
upheld you will be required to complete this course prior to getting your
license reissued. Below is an incomplete list of places that
provide this class. This Office does not endorse any particular driving

Check listings under your local Yellow Pages under "Driving
Schools." Make sure it is state licensed.
Tuition Fees Level I DUI Class is 12 hours long and costs $180.00. Level II DUI Class is 21 hours long and costs $250.00.
Reassignment Fees Level I for first time reassignment $40.00; second $80.00;
thereafter $160.00. Level II for first time reassignment $57.50; second $115.00; thereafter
$230.00. Evaluations Level I for first time reassignment $80.00; thereafter $160.00. Level II for first time reassignment
$115.00; thereafter $230.00.
TO ENROLL required documentation:
1. Driver's License number and driving record. 2. Arrest Affidavit (Arrest Report or Crash Report) 3. Citation (Ticket) 4. BAC Level (Breath/Blood Alcohol Level) 5. Court Case Number, if case is pending - Court Disposition Order if
convicted.
Registration takes between 2-3 hours
and tuition fees are due at registration.
Non-U.S. Citizens' Requirements
Non-United States Citizens have additional requirements in order to obtain a
Florida driver's license. Non-United States citizens must present the
following valid documents:
- Alien registration receipt card (I-151, I-155), or
- Employment authorization card (I-688B, I-766), or
- Proof of non-immigrant classification (I-94) and passport, if required,
and
- One acceptable form of secondary identification
Non-United States citizens applying for a driver license will receive a
30-day temporary permit and a receipt. Non-United States citizens applying
for an ID card will receive a receipt. After document validation is
performed, a driver license or ID card will be mailed within 30 days.
Canadian Citizens
Canadian citizens without INS documents must present two of the following
valid documents:
- Canadian passport
- Canadian driver license
- Canadian birth certificate (original or certified copy)
Canadian citizens applying for a driver license will receive a 30-day
temporary permit and a receipt. Canadian citizens applying for an ID card
will receive a receipt. After document validation is performed, a driver
license or ID card will be mailed within 30 days.
Business Purposes Only Driver's
License
This type license allows people to drive only in those instances to
maintain their livelihood. See State v. Quiroli, 9 Fla. L.
